Abstract
Thank you very much indeed. I propose to share with you a few thoughts on acute problems and difficulties besetting the international criminal tribunal for the former Yugoslavia. I must say, however, that I had a wonderful dinner, sitting between two charming ladies and I think that one of them at least got terribly depressed after chatting with me, so I hope I will not depress you as well. I'll do my best. However, I think that I should focus on some of these particular problems by contrasting the role and the way our tribunal goes about dispensing international justice with domestic criminal courts. And in this way, probably, the particular difficulties which we have to face almost every day will become clearer. First of all, I will divide my talk into two parts. First, I will focus on some functions that we have to fulfill at the Hague and which are unfamiliar to domestic criminal courts. That, therefore, makes our burden even heavier. And then I will focus on the particular difficulties which are inherent in any international criminal jurisdiction.
