Abstract
This article focuses on the particular characteristics of the European Community legal and administrative system which prevent consideration of the European Union as a homogeneous environmental regulatory territory. First, I will examine the respective powers of the European Community and of the Member States under the EEC Treaty to take environmental initiatives. The European Community has not been conferred exclusive jurisdiction to protect the environment. Environmental policy in the European Union results from the conjunction and superposition of legislative actions by the EC and the Member States. In a second part, I will change the perspective and look at the capability of the EC legal and administrative system to guarantee uniform implementation and enforcement of EC environmental legislation where enacted.
